CALL TO ORDER:
    The regular meeting of the City Planning Commission was called to order at 7:30 p.m. by Chairman Rasmussen.

Present:    Chairman Rasmussen, Vice-Chairman Whalen, Commissioner Brewer, Commissioner Williams, Commissioner Matsuhara
Absent:    Commissioner Rajander, Commissioner Gjervold
Also Present:    Planning Director Werner, Senior Planner Sexton, Assistant Planner Traut, Assistant Planner Buderi, Assistant Director of Public Works Baird

1.    CONSENT CALENDAR:
    None.

2.    JOHNIFER CONDOMINIUMS - Johnifer Company, applicants
    a.    Environmental Assessment (REA-28-85)
    b.    Planned Unit Development (PUD-10-85)
    c.Tentative Map (TM-7-85)
    Pertains to the proposed development of a 76-unit condominium project on 3.8 acres located on the southeast corner of Nut Tree Road and Marshall Road extension. The project design includes 2 story high buildings and the units may be rented out prior to being offered for individual sale.

    Assistant Planner Traut reviewed the proposal and introduced the staff report dated July 16, 1985 into the record, noting that the project site lies within the Oakview Planned Unit Development and the proposed 76-unit project would be at the maximum 20 dwelling units per acre as set forth by the Oakview PUD.  The project consists of stacked units within eight eightplex buildings and one twelveplex building with a "community building" near the pool.

    Staff recommended approval of the project.

COMMISSION ACTION:
Environmental Assessment:
    Commissioner Brewer moved, Whalen seconded, that the Planning Commission approve Environmental Assessment (REA-28-85), as reaffirming the previous Negative Declaration (EA-30-80), in accordance with the California Environmental Quality Act and supported by the following findings:  A and B, as listed in staff report.  Motion approved 5-0.

Planning Unit Development:
    Commissioner Brewer moved, Whalen seconded, that the Planning Commission approve Planned Unit Development (PUD-10-85) subject to Mandatory Findings (a-g) and Finding (1-6) of Section 17.54.070(c) of the Municipal Code and subject to the following conditions:  A-P as listed in staff report.  Motion approved 5-0.

Tentative Map:
    Commissioner Brewer moved, Whalen seconded, that the Planning Commission approve Tentative Map (TM-7-85) subject to Mandatory Findings (a-g) and subject to the following conditions:

    A.    Compliance with Standard Conditions for Tentative Map (A,C-K) including Public Works Memo #249, dated June 27, 1985.
    B.    That the developer comply with the conditions of approval for PUD-10-85 as approved by the Planning Commission.

Motion approved 5-0.

4.    WOODCREST SUBDIVISION - Reiners & Hayes, applicant
    a.    Environmental Assessment (REA-39-85)
    b.    Planned Unit Development (PUD-16-85)
    c.    Tentative Map (TM-8-85)
    d.    Zone Change (Z-9-85)
    Pertains to the development of 104.3+ acres in the Browns Valley on the west side of Browns Valley Road immediately north of the Markham Heights Subdivision, with 211 single family homes, 128 apartments and 37 custom lots.  The request also involves changing the zoning from A-20, R-1-10,000, R-1-8000, R-1-6000, RM-3000 and RM-Variable to A-20, R-1-8000 PD, R-1-Variable PD and RM-2000 PD.

    Community Development Director Werner reviewed the proposal and introduced the staff report dated July 16, 1985 into the record, noting that two steep slope areas, 18.4 acres adjoining the Browns Valley Parkway and 16.4 acres in the western portion of the site, would be dedicated as public open space to be maintained through a parks maintenance district.  The proposal additionally would involve a density bonus, four percent (12 units) greater than the base unit allowance in the Browns Valley Service and Density Policy.

    Staff recommended approval of the project.

PUBLIC HEARING:
Those speaking in favor of the project:
    Donn Reiners, representing the property owner, American Savings, stated that the underground drainage pipe would eliminate runoff onto Markham lots; common rear yards would meet the same width as abutting existing lots and zero lot homes would be 35' to 40' away from Markham homes.

Those speaking in opposition to the project:
    Rick Ellson, 126 Markham, concerned about flooding.
    Resident, 148 Markham, concerned about adjoining lot sizes.

COMMISSION ACTION:
Environmental Assessment:
    Commissioner Williams moved, Matsuhara seconded, that the Planning Commission approve an Environmental Assessment (REA-39-85) reaffirming the previously approved Subsequent EIR for the Browns Valley Area for this project in accordance with the provisions of CEQA and with the following findings:  a and b as listed in staff report.  Motion approved 5-0.

Planned Unit Development:
    Commissioner Williams moved, Matsuhara seconded, that the Planning Commission approve Planned Unit Development (PUD-16-85) for the proposed development subject to Mandatory Findings (a-g) and findings 1-6 for Section 17.54.070(c) of the Zoning Ordinance and to the following conditions of approval:  A-G, as listed in staff report.  Motion approved 5-0.

Tentative Map:
    Commissioner Williams moved, Matsuhara seconded, that the Planning Commission approve Tentative Map (TM-8-85) subject to Mandatory Findings (a-g) and the following conditions of approval:  A through H, as listed in staff report.  Motion approved 5-0.

Zone Change:
    Commissioner Williams moved, Matsuhara seconded, that the Planning Commission recommend that the subject 104.3+ acres be rezoned to the A-20, R-1-10,000 PD, R-1-Variable and RM-2000 PD districts per Zone Change Z-9-85 subject to the following findings:  a and b as listed in staff report.  Motion approved 5-0.

5.    CAVALLAS APARTMENTS - LeDean Garrison, applicant
    a.    Environmental Assessment (REA-32-85)
    b.    Planned Unit Development (PUD-13-85)
    Pertains to the development of 3+ acres with 36 apartments located on the north side of California Drive immediately east of Irene Larson School.

    Assistant Planner Buderi reviewed the proposal and introduced the staff report dated July 16, 1985 into the record, noting that the development consists of 36 units in 4 one-story and 3 two-story buildings.  Some revisions to the site plan would be necessary, as stated in the conditions of approval.

PUBLIC HEARING:
Those speaking in favor of the project:
    LeDean Garrison, representing the owners, said that the revisions could be worked out and that the property owners own this lot through to Alamo, and will solve the sewer problems for this lot.

Those speaking in opposition to the project:
    None.

COMMISSION ACTION:
Environmental Assessment:
    Commissioner Brewer moved, Whalen seconded, that the Planning Commission approve Environmental Assessment (REA-32-85) reaffirming that previously approved environmental review for this property adequately addresses this project and finding that the project will not have a significant impact on the environment.  Motion approved 5-0.

Planned Unit Development:
    Commissioner Brewer moved, Whalen seconded, that the Planning Commission approve Planned Unit Development (PUD-13-85) for the proposed Cavallas Apartments, subject to Mandatory Findings (a-g) and findings 1-6 of Section 17.54.070(c) of the Vacaville Municipal Code, and the following conditions of approval: A through H, as listed in staff report.  Motion approved 5-0.

6.    ESPINOSA DUPLEX - Hank Espinosa, applicant
    a.    Environmental Assessment (REA-35-85)
    b.    Planned Unit Development (PUD-14-85)
    c.    Zone Change (Z-10-85)
    Pertains to the development of a duplex on .2+ acres, utilizing the existing house at 513 Elizabeth Street.  The request also involves the rezoning of approximately .75+ acres located along the east side of Elizabeth Street between McKnight and Stevenson Streets from CO (Office Commercial) to RM-Variable.

    The project was withdrawn by the applicant.  Chairman Rasmussen moved, Whalen seconded, that the rezoning be brought back to the Commission within the next two meetings.  Motion approved 5-0.

7.    TRINITY BAPTIST CHURCH VARIANCE - Pastor Milton Steck, applicant
    a.    Variance (V-24-85)
    Pertains to a request to delete the requirement for a 6-foot high masonry wall along the northerly 180+ feet of the westerly property line adjoining a proposed parking area at Trinity Baptist Church located at 401 W. Monte Vista Avenue.

    Assistant Planner Traut reviewed the proposal and introduced the staff report dated July 16, 1985 into the record.

    Staff recommended approval of the project.

COMMISSION ACTION:
    Commission Brewer moved, Whalen seconded, that the Planning Commission approve the Trinity Baptist Church Variance request (V-24-85) to delete the requirement for a six-foot high masonry wall along the west property line adjoining the new parking lot expansion, as meeting the five required findings.  Motion approved 5-0.

    The regular meeting of the City Planning Commission was adjourned at 9.12 p.m.
