CALL TO ORDER:
    The regular meeting of the City Planning Commission was called to order at 7:30 p.m. by Chairman Rasmussen.

Present:    Chairman Rasmussen, Vice-Chairman Whalen, Commissioner Brewer, Commissioner Rajander, Commissioner Gjervold, Commissioner Matsuhara, Commissioner Williams
Absent:    None
Also Present:    Community Development Director Werner, Senior Planner Sexton, Assistant Planner Traut, Assistant Planner Buderi, Assistant Public Works Director Baird

COMMUNICATIONS:
    Memo requesting continuance of Item 5, Shaffer Variance, as requested by the applicant.

MISCELLANEOUS:
    None.

1.    CONSENT CALENDAR:
    Commissioner Whalen moved, Gjervold seconded, to approve the following items listed on the Consent Calendar.  Motion approved 7-0.

    July 2, 1985
    July 16, 1985
    August 6, 1985

2.    SYCAMORES UNIT 5 - Lewis Homes, applicant
    a.    Environmental Assessment (REA-31-85)
    b.    Tentative Map (TM-6-85)
    c.    Planned Unit Development (PUD-12-85)
    d.    Zone Change (Z-8-85)
    Pertains to the subdividing and rezoning of 3.4+ acres located along the east side of Tulare Drive 100 feet south of Persimmon Circle, to permit the construction of 20 single family homes.  The rezoning is from RM-2000 PD to R-1-Variable PD.

    Assistant Planner Buderi reviewed the proposal and introduced the staff report dated August 20, 1985 into the record, noting that the site was originally approved for townhouse units, however, conversion to single family use in this area would not cause any major problems.  Staff recommended approval of the project.

PUBLIC HEARING:
Those speaking in favor of the project:
    Steven Hicks, representing McKay and Somps, asked that Condition #15 of Public Works memo be deleted due to the configuration of the site.

Those speaking in opposition to the project:
    None.

Public hearing closed.

    Assistant Public Works Director Baird stated that the conditions could be deleted from the memo, however, it is part of the City Standards and Specifications.

COMMISSION ACTION:
Environmental Assessment:
    Commissioner Rajander moved, Brewer seconded, that the Planning Commission approve Environmental Assessment (REA-31-85) reaffirming that the previous environmental assessment prepared for this property adequately addresses the effects of this project.  Motion approved 7-0.

Planned Unit Development:
    Commissioner Rajander moved, Brewer seconded, that the Planning Commission approve Planned Unit Development (PUD-12-85) subject to Mandatory Findings (a-g) and findings 1-6 of Section 17.54.070(c) of the Zoning Ordinance and to the following conditions of approval:

A.    That the developer comply with Standard Conditions of Approval (A,F, J-N) including the requirements of Public Works memo #242 dated June 20, 1985 as applicable to the single family development (delete #15 of Public Works memo).
B.    That the developer comply with the requirements of Fire Department memo dated June 20, 1985 as they apply to the single family development.
C.    All required fencing shall be constructed prior to the occupancy of the dwelling units for which such fencing is required.
D.    A six foot masonry wall shall be constructed along the south property line of the proposed project if the single family units are constructed prior to the adjacent multi-family project.

Motion approved 7-0.

Tentative Map:
    Commissioner Rajander moved, Brewer seconded, that the Planning Commission approve Tentative Map (TM-6-85) subject to Mandatory Findings (a-g) and the following conditions of approval:

A.    That the developer comply with Standard Conditions of Approval for Tentative Maps (A,C-D,F-K) including Public Works memo #242 dated June 20, 1985.
B.    Compliance with the requirements of Fire Department memo dated June 20, 1985 as they apply to this Tentative Map.
C.    Any conditions of approval for PUD-12-85 AND Zone Change Z-8-85 which are applicable to this Tentative Map shall be complied with prior to recording of the Final Map.
D.    The S.I.D. certificate shall be added to the Final Map.

Motion approved 7-0.

Zone Change:
    Commissioner Rajander moved, Brewer seconded, that the Planning Commission recommend to the City Council that the 3.4+ acre site on the east side of Tulare Drive, 100' south of Persimmon Circle be rezoned from RM-2000 PD to R-1-Variable PD as proposed by Zone Change (Z-8-85) subject to the following findings:

A.    That the proposed zoning is consistent with the General Plan.
B.    That the proposed zoning will not be detrimental to the public health, safety or welfare of the community.

Motion approved 7-0.

3.    VACAVILLE TOWNHOUSES AND OFFICE COMPLEX - Brian Silk, applicant
    a.    Environmental Assessment (EA-19-85)
    b.    Planned Unit Development (PUD-17-85)
    c.    Zone Change (Z-11-85)
    d.    Tentative Map (TM-11-85)
    e.    Policy Plan (PP-1-84)
    Pertains to the development of 8.6+ acres located at the northwest corner of Peabody Road and California Drive with 128 townhouse units and 43,500 square feet of office buildings, including common recreational facilities.  The rezoning request is from RM-3000 PD to RM-Variable PD.  The proposal also involves some revisions to the Alamo-Peabody Policy Plan.

    A continuance was requested to provide time for the applicant to complete revised plans.

    Chairman Rasmussen moved, Whalen seconded, that this item be continued to a date uncertain.  Motion approved 7-0.

4.    VILLAGE EAST COMMERCIAL CENTER - Harry Schneider, applicant
    a.    Environmental Assessment (REA-43-85)
    b.    Conditional Use Permit (CUP-14-85)
    Pertains to the proposed construction of a 12,800 square foot commercial building with provisions for gasoline sales, to be located on the southeast corner of Alamo Drive and Nut Tree Road.

    Assistant Planner Traut reviewed the proposal and introduced the staff report dated August 20, 1985 into the record, noting that the design aspects of the project were approved by the Design Review Committee at their meeting of August 15, 1985.  Staff recommended approval of the project.

PUBLIC HEARING:
Those speaking in favor of the project:
    Harry Schneider, applicant, stated that the project was the same as originally approved.

Those speaking in opposition to the project:
    Trent Fry, area resident, opposed the gasoline sales.

Public hearing closed.

COMMISSION COMMENTS:
Environmental Assessment:
    Commissioner Brewer moved, Whalen seconded, that the Planning Commission approve Environmental Assessment (REA-43-85) as reaffirming the village East EIR and meeting the following findings:

A.    The project does not involve any significant impacts which were not adequately addressed in the previous EIR.
B.    A subsequent EIR is not required pursuant to Section 15162 of the State CEQA Guidelines.
C.    Mitigation measures have been incorporated into the project as conditions of approval.
Motion approved 7-0.

Conditional Use Permit:
    Commissioner Brewer moved, Whalen seconded, that the Planning Commission approve Conditional Use Permit (CUP-14-85) as meeting the required findings for conditional use permits and the following conditions of approval:

A.    Compliance with the conditions of Design Review as approved by the Design Review Committee.
B.    Compliance with Public Works memo #304, dated August 8, 1985.
Motion approved 7-0.

5.    SHAFFER VARIANCE - Elroy Shaffer, applicant
    a.    Variance (V-29-85)
    Pertains to a request to reduce the minimum driveway width from 18 feet to 13 feet and the minimum planter width from 5 feet to 2 feet in conjunction with the proposed construction of a fourplex on the rear of the property located at 350 Brown Street.

    The applicant requested a continuance to reconsider the design of the project.

    Chairman Rasmussen moved, Rajander seconded, to continue this item to a date uncertain.  Motion approved 7-0.
