7:30 p.m. - City Council Chambers October 1, 1985
CALL TO ORDER:
The regular meeting of the City Planning Commission was called to order at 7:30
p.m. by Chairman Rasmussen.
Present: Chairman Rasmussen, Vice-Chairman Whalen, Commissioner Brewer,
Commissioner Gjervold, Commissioner Rajander, Commissioner
Matsuhara
Absent: None.
Also Present: Planning Director Werner, Senior Planner Sexton, Assistant Planner
Traut, Assistant Planner Buderi, Assistant Public Works Director Baird
COMMUNICATIONS:
a. Petition and letter supporting Item 2.
b. Residential Vacancy Survey Report.
MISCELLANEOUS:
None.
1. CONSENT CALENDAR:
Commissioner Whalen moved, Brewer seconded, to approve
the following items as
listed on the Consent Calendar. Motion approved 6-0.
a. SUMMERFIELD - TIME EXTENSION - CITATION HOMES, applicant
Pertains to request for a one-year extension for a planned
unit development
(PUD-10-83) and tentative map (TM-9-83) for 219 residential units on 51.9+ acres
located at the northwest corner of Nut Tree Road and Elmira Road.
b. ROUND OAK VILLAGE #2 - TIME EXTENSION - Joan Buhlman,
applicant
Pertains to a request for a one-year extension for a planned unit development
(PUD-17-84) for a 76 unit apartment complex to be located on the northeast corner
of California and Alamo Lane.

2. BIGELOW HOME OCCUPATION PERMIT APPEAL - Phyllis & Josephine Bigelow,
applicants
a. An appeal of the Community Development Director's
determination to deny
a request to an exception to the home occupation performance standards to allow
dance classes to be held at 247 Plum Street.
Assistant Planner Traut reviewed the proposal and introduced the staff report
dated
October 1, 1985 into the record, noting that staff felt that the use does not meet the
intent of the Home Occupation Ordinance.
Staff recommended denial of the project.
PUBLIC HEARING:
Those speaking in favor of the project:
Josephine Bigelow, stating that her mother had started teaching dancing in her
home 30 years ago, then changed to the Veterans Hall. Six years ago they began
teaching at home again. She presented a petition with 16 signatures of neighbors
station that it did not cause a problem in the neighborhood. Classes would be held one
day a week.
Kathleen Sutton, in favor of the exception.
Those speaking in opposition to the project.
None.
Public hearing closed.
COMMISSION COMMENTS:
The Commission felt that the request could be approved and that the ordinance
should be revised to establish guidelines pertaining to this section to allow a broader
view in processing.
COMMISSION ACTION:
Commissioner Rajander moved, Gjervold seconded, to approve the appeal and
allow the dance classes one day a week, as stated by the applicant. Motion approved
6-0.
3. BOMAN VARIANCE - Dennis Boman, applicant
a. Variance (V-34-85)
Pertains to reduce the rear yard setback from 20 ft. to 13 ft. in order to permit
an
addition on to the rear of the dwelling located at 456 Robert Road.
Assistant Planner Buderi reviewed the proposal and introduced the staff report
dated October 1, 1985 into the record.
Staff recommended approval of the project subject to conditions as listed in
staff
report.

COMMISSION ACTION:
Commissioner Gjervold moved, Whalen seconded, that the Planning Commission
approve Variance V-35-85 as meeting the five required findings as required by Section
17.75.070 of the Vacaville Municipal Code as outlines in this staff report and subject to
the following conditions:
1. The project shall be in conformance with the plans on file with the Planning
Division, dated July 30, 1985, except as modified by the conditions noted below.
2. The applicant shall secure Building Permits prior to any further construction on
this project.
3. Prior to issuance of Building Permits the roof connection between the room
addition and the covered patio area shall be removed as proposed by the applicant.
4. Prior to issuance of Building Permits the mudsill and all wall framing shall be
removed from the patio cover area. The patio cover shall remain open on three
sides.
Motion approved 6-0.
